HHS Releases HIPAA Privacy and Security and Breach Notification Rules

January 18, 2013—The Department of Health and Human Services (HHS) Office of Civil Rights Jan. 17 released the prepublication copy of the final rules on the Health Insurance Portability and Accountability Act (HIPAA) Privacy and Security and Breach Notification and the Genetic Information Non-discrimination Act (GINA).

The final rule:

  • Modifies the HIPAA Privacy and Security and Breach Notification Rule to implement statutory amendments under the Health Information Technology for Economic and Clinical Health Act (HITECH Act), included in the American Recovery and Reinvestment Act (P.L. 111-5), to strengthen the privacy and security protection for individuals’ health information;

  • Modifies the rule for Breach Notification for Unsecured Protected Health Information (Breach Notification Rule) under the HITECH Act, which addresses public comment received on the interim final rule;

  • Modifies the HIPAA Privacy Rule to strengthen the privacy protections for genetic information by implementing Section 105 of Title I of the Genetic Information Nondiscrimination Act of 2008 (GINA, P.L. 110-233); and

  • Makes certain other modifications to the HIPAA Privacy, Security, Breach Notification, and Enforcement Rules to improve their workability and effectiveness and to “increase flexibility for and decrease burden on the regulated entities.”
