A group of six Republican House members from New York, led by Rep. Mike Lawler (R-N.Y.), sent a letter to the Centers for Medicare & Medicaid Services (CMS) Administrator Mehmet Oz (PDF) expressing concern regarding the agency's proposal to reduce Medicare reimbursement for 340B drugs. The CMS' calendar year (CY) 2027 Outpatient Prospective Payment System (OPPS) proposed rule would reduce Medicare Part B payment for 340B-acquired drugs from average sales price (ASP) plus 6% to ASP minus 33.4% beginning Jan. 1, 2027, a policy that the AAMC opposes [refer to related story].
In their Aug. 31 letter, the members highlight the negative impacts of this policy on New York's safety-net hospitals, noting, "such a precipitous drop in reimbursement payments creates significant financial uncertainty for the providers 340B seeks to bolster." The letter urges the CMS to "seriously reconsider" this policy when finalizing the CY 2027 OPPS final rule.
