    AAMC-Supported House Letter Urges Enforcement Action Against J&J for Proposed Rebate Model

    Reps. Abigail Spanberger (D-Va.) and Dusty Johnson (R-S.D.) led a bipartisan Sept. 30 letter to the Department of Health and Human Services Secretary Xavier Becerra expressing concern regarding Johnson & Johnson’s recent proposal to replace upfront 340B discounts (PDF) with a retrospective rebate for certain drugs purchased by disproportionate share hospitals. The letter was signed by 187 additional members of Congress and endorsed by several national associations representing 340B-covered entities, including the AAMC, 340B Health, the American Hospital Association, and others.

    Johnson & Johnson announced on Sept. 30 it would be withdrawing the model, citing a Sept. 27 letter from Carole Johnson, administrator of the Health Resources and Services Administration, threatening to revoke their pharmaceutical pricing agreement if they move forward with the model [refer to related story].
