The AAMC submitted comments on Feb. 17, raising significant concerns with two proposed rules issued by the Centers for Medicare & Medicaid Services (CMS) that address gender-affirming care. One comment letter (PDF) responded to a proposed rule that would amend the conditions of participation to bar hospitals that perform gender-affirming care to youth from participation in the Medicare and Medicaid programs. The other comment letter (PDF) responded to a proposed rule that would prohibit federal Medicare funding for gender-affirming care provided to patients under 18 and prohibit reimbursement through the Children’s Health Insurance Program for patients under the age of 19. The AAMC urged the agency to withdraw the rules because they exceed the CMS’ statutory authority, intrude upon state regulation of medical practice, undermine the physician-patient relationship, and threaten access to care.
