The policy would not apply to cap-exempt H-1B applications; AAMC members generally would not be directly affected by the proposed fee because institutions of higher education and certain affiliated or related nonprofit entities are exempt from the H-1B cap. However, the association shared its concern that this proposal represents poor policy based on untested legal authority. The AAMC noted that the analysis by the DHS to justify this policy could establish a dangerous precedent for other policies that could negatively impact academic medicine.
