Senate Holds Hearing on Proposed EPA Rule

October 5, 2018—The Senate Committee on Environment and Public Works Subcommittee on Superfund, Waste Management, and Regulatory Oversight Oct. 3 held a hearing titled, “Oversight of the Environmental Protection Agency’s Implementation of Sound and Transparent Science in Regulation.” The hearing focused on a proposed rule from the Environmental Protection Agency (EPA), which would limit the science the agency could consider in rulemaking to research for which all underlying data are publicly available.

The AAMC previously submitted a joint letter to the EPA opposing the rule and stating that it “thwarts the promise of evidence-based policymaking” [see Washington Highlights, July 13]. The agency has received approximately 590,000 comments on the proposed rule, just over 9,000 of which are available on the public docket.

Witnesses at the hearing included Edward J. Calabrese, PhD, professor, University of Massachusetts at Amherst School of Public Health and Health Sciences; Robert Hanh, visiting professor, Oxford University Smith School of Enterprise and the Environment; and Rush D. Holt, PhD, chief executive officer, American Association for the Advancement of Science.

In written testimony, Holt noted that the “EPA is legally required to base its work on current scientific research ... The Transparency Rule that you are considering is opposed by many — I think, most — scientists and scientific organizations because, contrary to the stated purpose of the rule, the rule would result in the exclusion of valid and important scientific findings from the regulatory process.”

Calabrese and Hanh, both in favor of the proposed rule, argued that it would lead to the agency using the best available science in the rulemaking process.
