CMS Releases Final Rule on Drug Price Transparency

May 10, 2019—The Centers for Medicare and Medicaid Services (CMS) May 8 released a final rule requiring drug manufacturers to disclose drug prices in direct-to-consumer (DTC) television advertisements. This follows the Oct. 15, 2018, publication of the proposed rule [see Washington Highlights, Oct. 19, 2018].

According to the final rule, DTC television advertisements for drugs covered by Medicare and Medicaid with a wholesale acquisition cost equal to or greater than $35 for a month’s supply, or the usual cost of therapy, are required to provide the list price in the advertisement. The final rule goes into effect 60 days after publication in the Federal Register. The fact sheet can be accessed here.
