Appellate Court Affirms Jung Lawsuit Dismissal

Washington, D.C., June 5, 2006 - A federal appeals court has affirmed a lower court's dismissal of the lawsuit, Paul Jung, M.D., et al. v. Association of American Medical Colleges, et al, the AAMC announced today.

In an opinion filed on June 1, a three-judge panel of the U.S. Court of Appeals for the District of Columbia upheld the U.S. District Court's August 2004 ruling dismissing the plaintiffs' complaint. The District Court concluded that the plaintiffs' antitrust claims were barred by the Pension Funding Equity Act of 2004 that exempted the National Resident Matching Program from antitrust laws.

"Unless the plaintiffs can convince the entire appellate court to re-hear their appeal, or convince the U.S. Supreme Court to hear the case, this decision means that the dark cloud of this destructive lawsuit has finally lifted," said AAMC President Jordan J. Cohen, M.D. "The National Resident Matching Program can continue to provide the nation with a fair and efficient process to train the highly skilled physicians America needs and deserves."
