Dept. of State Releases J-1 Visas Rules for SEVIS

December 20, 2002 - The Department of State Dec. 12 published regulations in the Federal Register [67 FR 76307] relating to the J-1 Exchange Visitor program as it relates to the Student and Exchange Visitor Information System (SEVIS). SEVIS is a database administered by the Immigration and Naturalization Service (INS) to track and record the entry and presence in the United States of foreign students and exchange visitors. The regulation is published as an interim final rule, meaning it takes effect immediately, but comments will be accepted until Jan. 13, 2003. INS published similar rules relating to F and M visa holders on Dec. 11 [see Washington Highlights, Dec. 13].

Under the Department of State rules, institutional sponsors of J-1 visa holders will be required to enroll in SEVIS and use the system to record all new J-1 visa holders beginning Jan. 30, 2003, and all existing J-1 visa holders by Aug. 1, 2003. For J-1 foreign physicians sponsored by the Educational Commission for Foreign Medical Graduates (ECFMG), the ECFMG serves as the sponsor and will work with the designated official at each host institution/teaching hospital to monitor the activities of the J-1 physicians.
