INS Publishes Final SEVIS
Rule, Alters Data Entry Deadline
December 13, 2002 - The Immigration and Naturalization
Service (INS) Dec. 12 published in the Federal Register
[67 FR 76256] a final rule implementing the Student and Exchange Visitor
Information System (SEVIS). SEVIS is a new database designed
to monitor and track international students studying in the
United States on F, M, and J visas. The final rule does not
make substantive changes, but extends until Aug. 1, 2003,
the deadline for schools to enter the names of all their international
students into the system. Earlier versions of the rule required
all data to be entered prior to the beginning of the first
term that begins after Jan. 30, 2003. This change delays the
deadline for schools with spring terms beginning after Jan.
30, but may advance the deadline for other institutions whose
next terms would begin in the fall. All schools are still
required to sign-up for and begin entering new students into
the SEVIS system by Jan. 30, 2003, or risk losing authority
to accept international students. The Department of State,
which has responsibility for several parts of the J-1 visa
program, has yet to release rules that specifically pertain
to J-1 visa sponsors. However, the INS rule notes that the
Service has been working closely with Department of State
staff to ensure consistent regulations.
