CMS Delays Physician Fee Schedule Rule

November 8, 2002-The Centers for Medicare and Medicaid Services (CMS) Nov. 5 published a notice in the Federal Register [67 FR 67318] announcing that the physician fee schedule will be delayed indefinitely due to problems with the data used to establish RVUs. The notice states that the lack of information is of such great magnitude that publishing the rule at this time would "significantly" affect the rates paid to "all physicians, non-physician practitioners, suppliers and providers…." The 2003 schedule was to have been published in the Federal Register on Friday Nov. 1, 2002. In June, CMS proposed a 2003 fee schedule with an overcall decrease of 4.4 percent. CMS has not yet made a statement about deadlines for physicians to indicate their participating or non-participating status in the Medicare program for FY 2003.
